Malcolm Meeks has over 24 years of experience in all phases of patent law, including complex litigation, portfolio management, and licensing. Through living in Germany and France and serving as in-house patent counsel for German and French corporations, Malcolm has exceptional insights into international implications of intellectual property strategy as well as an understanding of IP’s impact on corporate risk planning, product development, and overall business strategy. He works with a wide range of technologies related to telecommunications, semiconductors, aerospace, cybersecurity, energy, consumer goods, and automotive.
Prior to rejoining Finnegan, Malcolm co-founded and served as the president director general of a Paris-based investment and consulting company focused on working with young (pre-seed and seed stage) French startup companies whose patentable technologies served as their business differentiator. Malcolm advised these companies both on their IP strategies to attract additional venture capital investment and on joint development agreements with larger corporations interested in their technologies.
Malcolm previously served as patent director of France Brevets, a quasi-government agency based in Paris established to protect and advance the French technology ecosystem via patent protection and licensing. He led litigations in the United States and Germany, including in district courts, before patent office tribunals, and appeals courts. Malcolm amassed a one hundred percent win rate across countries and venues, resulting in substantial licensing revenues for French interests. Malcolm also managed a program known as the “Patent Factory,” serving as the de facto chief patent counsel for over 20 French startups and research institutions. He aided startups, universities, and research institutions throughout France in identifying and protecting their key innovations relevant to promising future markets. Under Malcolm’s leadership, the Patent Factory members collectively represented the sixth largest filer of patents at the European Patent Office (EPO) in 2016. Multiple companies in the program raised over 20 million euros each in either venture capital or proof-of-concept funding based on the strength of their patent positions. On numerous occasions, Malcolm represented France Brevets at the European Commission, advocating for stronger patent rights in the European Union.
Malcolm’s work experience includes serving as director, corporate patent at Infineon Technologies in Munich, Germany. He led out-bound licensing efforts, including managing one of the largest patent litigations in the US at the time. He managed the case to a successful conclusion resulting in a licensing agreement and a significant licensing payment of double-digit millions to the company. He also advised executive management on intellectual property issues impacting the enterprise.
While an associate at Finnegan, prior to moving to Germany, Malcom focused on high-stakes, complex patent litigation, including trial work resulting in verdicts totaling over $100 million for firm clients.
